About The Beauty RS

The Beauty RS is a beauty technology platform designed to help users organise, understand and make better use of their makeup, skincare, haircare and related beauty products. Features may include:

• —barcode and product scanning
• —shade and product recall
• —expiry and period-after-opening tracking
• —product ratings and preferences
• —Wishlists and shopping lists
• —retailer discovery
• —personalised makeup looks
• —skincare routines
• —Beauty Circles and community features
• —product discovery
• —notifications and reminders
• —artificial-intelligence-powered features

Features may be introduced, changed or removed as the service develops.

Eligibility

The Beauty RS application is intended for users who are 18 years of age or older, unless we expressly state otherwise for a particular service or jurisdiction. By creating an account, you confirm that you meet the applicable age requirement and that the information you provide is accurate.

Your account

You are responsible for:

• —providing accurate account information
• —keeping your login details secure
• —protecting access to devices signed into your account
• —notifying us if you believe your account has been accessed without permission

You must not share account credentials in a way that compromises the security of the service. You are responsible for activity performed through your account unless the activity results from circumstances for which you are not reasonably responsible.

Your Beauty Collection

The Beauty RS allows you to create and maintain a personal digital record of beauty products you own, use, save or are interested in. Product information may include:

• —brand
• —product name
• —category
• —shade or variant
• —size
• —opening date
• —expiry information
• —product status
• —rating
• —notes
• —favourites
• —recommendation preferences
• —other information you choose to provide

Your digital Collection is an organisational tool. It does not replace product packaging, manufacturer instructions or your own physical inspection of a product.

Product information and the Beauty RS database

The Beauty RS may obtain product information from:

• —our own product database
• —licensed datasets
• —barcode and product information services
• —brands and manufacturers
• —retailers
• —publicly available sources
• —users
• —other approved data providers

We take reasonable steps to improve product-data quality, but we cannot guarantee that every product record will always be complete, current or error-free. Product formulations, ingredients, packaging, shades, sizes and manufacturer information can change. You should check the actual product packaging and manufacturer information where accuracy is important.

Barcode scanning and product matching

Barcode scanning and other identification tools are designed to assist with product recognition. A barcode or other identifier does not always guarantee an exact product match. The Beauty RS may ask you to confirm a suggested match or provide additional information where product identity is uncertain. Where a product cannot be confidently identified, it may be treated as unverified or require manual entry.

User-submitted and custom products

Users may be able to add products that are not already available in the Beauty RS database. Some custom products may remain private to the user's Collection. Where you voluntarily submit product information for consideration for inclusion in the shared Beauty RS database, you confirm that:

• —the information is accurate to the best of your knowledge
• —you have the right to provide any images or content submitted
• —the content does not infringe another person's rights

You retain ownership of content you own. Where content is submitted for inclusion in the shared product database, you grant The Beauty RS a non-exclusive, worldwide, royalty-free licence to store, reproduce, review, verify, standardise, adapt and display that content as reasonably necessary to operate and improve the Beauty RS product database. This licence does not give us ownership of your private Collection, private notes or personal information. We may correct, reject, remove or decline to publish submitted product information where reasonably necessary for accuracy, security, legal compliance or service integrity.

Ratings and product preferences

Users may rate products and indicate preferences such as whether a product should be included in recommendations. Ratings and preferences may be used to personalise Beauty RS functionality. A user's personal rating represents that user's opinion and does not constitute a scientific, medical or professional assessment of the product.

Artificial intelligence

Certain Beauty RS features may use artificial intelligence to generate makeup looks, skincare routines, product suggestions or other personalised outputs. AI-generated content may contain errors or may not be suitable for every individual. Where applicable, users should follow:

• —manufacturer instructions
• —product warnings
• —patch-testing guidance
• —professional advice
• —appropriate medical advice

rather than relying solely on an AI-generated recommendation.

No medical advice

The Beauty RS is a beauty technology service. It is not a medical service and does not provide medical diagnosis, treatment, dermatological advice, pharmaceutical advice or other professional healthcare advice. Information about skincare, sensitivities, ingredients or routines is provided for informational and organisational purposes only. If you have a medical condition, allergy, severe reaction, persistent skin concern or other health issue, you should seek appropriate advice from a qualified healthcare professional.

Expiry and product reminders

The Beauty RS may provide reminders relating to:

• —expiry dates
• —period after opening
• —stock levels
• —product use
• —other Collection information

These reminders depend on information entered by the user, product data available to us and successful notification delivery. You remain responsible for checking a product's physical condition, packaging and manufacturer instructions before use. The absence of a notification does not mean that a product is necessarily suitable for continued use.

Subscriptions

The Beauty RS may offer free and paid subscription plans. Subscription features, allowances and pricing will be displayed before purchase. Paid subscriptions may include benefits such as:

• —higher or unlimited Collection allowances
• —AI-generated looks and routines
• —additional saved content
• —enhanced personalisation
• —advanced filters
• —other premium features

The features included in each subscription tier will be displayed at the time of purchase. Where a subscription is described as auto-renewing, it will continue and the applicable subscription fee will be charged at the relevant billing interval unless cancelled before renewal. The applicable price, billing frequency, renewal terms and trial or promotional terms will be displayed before you subscribe.

AI generation allowances

Some subscription plans may include a specified number of AI-generated makeup looks and skincare routines during each subscription period. Unless expressly stated otherwise:

• —AI allowances reset at the beginning of each applicable billing period
• —unused monthly allowances do not roll over
• —allowances cannot be exchanged for cash
• —allowances are personal to the account
• —generating or regenerating an AI output may count towards the applicable allowance where clearly indicated in the application

The Beauty RS may introduce optional additional AI-generation purchases in the future. Any price and applicable conditions will be shown before purchase.

Payments

Mobile subscription payments may be processed through platforms such as:

• —Apple App Store
• —Google Play

Those transactions may also be subject to the applicable platform's payment and subscription terms. The Beauty RS does not receive or store your full Apple or Google payment-card credentials.

Cancellation

You may cancel an auto-renewing subscription through the applicable subscription-management process. Cancelling generally prevents future renewal but does not necessarily terminate paid access immediately. Access may continue until the end of the period already paid for, subject to the applicable store rules.

Refunds and consumer rights

Refund eligibility may depend on:

• —the platform through which the purchase was made
• —applicable store rules
• —applicable consumer law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law. Where mandatory consumer protections apply, those protections prevail over any inconsistent provision in these Terms.

Retailers and Where to Buy

The Beauty RS may display retailers or provide links showing where beauty products may be available. Retailer information is provided for convenience and may not represent every retailer or every available offer. A retailer appearing within The Beauty RS does not guarantee that:

• —a particular product is currently stocked
• —the displayed product or shade is available
• —pricing is current
• —delivery is available in your location
• —the retailer is the lowest-priced option

You should verify final product, price, shade, shipping and other purchase information directly with the retailer.

Affiliate relationships and discount codes

The Beauty RS may enter commercial, referral or affiliate relationships with retailers, brands or other partners. We may receive a commission or other benefit where a user interacts with or purchases through an eligible link. Retailers offering Beauty RS promotions or discount codes may be displayed more prominently in designated parts of the service. Where required, commercial relationships will be appropriately disclosed.

Third-party services

The Beauty RS may contain links to, integrate with or rely on services operated by third parties. These may include retailers, technology providers, payment platforms and other services. Your interaction with a third-party service may be governed by that third party's own terms and privacy policy. We are not responsible for the independent acts, websites, pricing, availability or policies of third parties except to the extent required by law.

Beauty Circles and community features

Where community, sharing or Beauty Circle features are available, you are responsible for information you choose to share with other users. You must not use these features to:

• —harass or threaten others
• —impersonate another person
• —publish unlawful content
• —distribute malicious material
• —infringe intellectual-property rights
• —disclose another person's private information without permission
• —engage in fraudulent or misleading activity

We may restrict or remove access where reasonably necessary to protect users, comply with law or maintain the integrity of the service.

Acceptable use

You must not:

• —attempt to gain unauthorised access to The Beauty RS systems
• —interfere with platform security
• —scrape or extract substantial amounts of data without permission
• —reverse engineer the service except where law expressly permits it
• —attempt to bypass subscription or feature restrictions
• —upload malware or harmful code
• —use automated systems in a way that materially disrupts the service
• —use The Beauty RS for unlawful, fraudulent or abusive purposes

Intellectual property

The Beauty RS platform and its proprietary materials may include:

• —software
• —branding
• —logos
• —databases
• —user-interface designs
• —text
• —taxonomy
• —recommendation systems
• —database structures
• —graphics
• —proprietary processes and other intellectual property

These materials are owned by or licensed to The Beauty RS and are protected by applicable intellectual-property laws. Except where expressly permitted, you may not reproduce, distribute, commercialise or create derivative works from our proprietary material without permission.

Service availability

We aim to provide a reliable service but cannot guarantee uninterrupted availability. The service may occasionally be unavailable because of:

• —maintenance
• —upgrades
• —third-party outages
• —network problems
• —security issues
• —circumstances outside our reasonable control

We may modify the service as it evolves. Where a material change affects a paid service, we will act reasonably and provide notice where appropriate.

Suspension and termination

We may suspend or restrict an account where reasonably necessary because of:

• —serious or repeated breaches of these Terms
• —fraudulent use
• —security concerns
• —unlawful activity
• —risks to other users or the platform

Where appropriate, we will provide notice and an opportunity to address the issue. You may stop using The Beauty RS at any time and may request deletion of your account in accordance with our Privacy and Confidentiality Policy.

Limitation of liability

To the maximum extent permitted by law, The Beauty RS is not liable for losses arising solely from:

• —reliance on inaccurate user-entered information
• —independent third-party retailer information
• —failure to follow manufacturer instructions
• —use of AI-generated content contrary to warnings or professional advice
• —events reasonably beyond our control

Nothing in this section limits liability that cannot legally be excluded or restricted.

Privacy

Our handling of personal information is explained in the Beauty RS Privacy and Confidentiality Policy. The Privacy and Confidentiality Policy forms an important part of your relationship with The Beauty RS and should be read together with these Terms.

Changes to these Terms

We may update these Terms as The Beauty RS develops or as legal or operational requirements change. Material changes will take effect prospectively and, where appropriate, we will provide reasonable notice. We will not rely on these Terms to make arbitrary changes that would unlawfully disadvantage consumers. The current version and effective date will be published on our website.

Governing law

These Terms are governed by the laws of Victoria, Australia, subject to any mandatory consumer or other legal protections applicable in the user's jurisdiction. Nothing in these Terms prevents a consumer from exercising rights available under applicable law.
